About these terms

These Terms of Service (Terms) are an agreement between you and Meezoy Ventures Private Limited (ParkQ, we, us) for your use of the ParkQ mobile app and the website at parkq.in (the Service). By creating an account or using the Service, you accept these Terms, our Privacy Policy, our Cancellation & Refund Policy and our Community Guidelines. If you do not agree, do not use the Service.

These Terms are an electronic record under the Information Technology Act, 2000 and do not need a physical or digital signature.

What ParkQ does

ParkQ is an online marketplace. Hosts list parking spaces they control, and parkers book them. The parking service is provided by the host, not by ParkQ. ParkQ provides the platform, verifies hosts and reviews listings, collects payments from parkers as a limited payment-collection agent for hosts, and pays hosts their earnings. ParkQ is an intermediary under the Information Technology Act, 2000 for content that users post.

ParkQ does not own, operate, guard or inspect parking spaces in person, and does not provide valet, security or insurance services.

Eligibility & accounts

• You must be at least 18 years old and able to enter into a contract under Indian law.
• You sign in with your mobile number and a one-time passcode (OTP). Keep your phone secure and never share an OTP. ParkQ staff will never ask for one.
• Your account details must be accurate and your own. One person may hold one account.
• You are responsible for activity on your account. Tell us at hello@parkq.in straight away if you think someone else has accessed it.
• We may ask you to verify your identity (KYC for hosts; an identity check for some bookings). We may refuse or limit the Service if verification is not completed.

Bookings (parkers)

• Before you pay, the app shows the full price, including the parking charge, any platform fee, GST and any discount, and the cancellation terms for that booking.
• Instant booking: the booking is confirmed once payment succeeds. Request to book: you pay when you send the request; the host must accept within the time shown, and never later than the start time. If the host declines or does not respond, the request is cancelled and you get a full refund.
• Use the booked space only for the vehicle on the booking, only during the booked time, and follow the host's entry instructions and the spot's rules.
• You can check in shortly before the start time using the gate pass in the app. Leave on time, or extend the booking in the app if the space is free.
• You park at your own risk. Lock your vehicle and do not leave valuables in it.

Hosting

When you list a parking space on ParkQ, you confirm and agree that:

• You own the space or have the legal right to rent it out, including any permission needed from a landlord, housing society, association or local authority.
• Your listing is accurate: location, photos, size, access, availability, prices and rules. You will keep it up to date.
• You will make the space available, safe and accessible for the full booked time, and will not cancel confirmed bookings without good reason.
• You will complete KYC (a government ID and a selfie) before listing a space, and keep a valid UPI ID to receive payouts.
• You are responsible for your own income tax, GST (if applicable) and any other taxes on your earnings. We may deduct or collect tax at source where the law requires, such as under section 194-O of the Income-tax Act or section 52 of the CGST Act, and will give you the related details.

Every listing is reviewed before it goes live, and we may decline, pause or remove a listing that breaks these Terms or our Community Guidelines.

Fees, payments & payouts

• Parkers pay the parking charge set by the host, plus any platform fee and applicable GST, all shown before payment. Payments are processed by our payment partner, Cashfree Payments, through UPI.
• Hosts pay ParkQ a commission on the parking charge for each completed booking. The commission rate is shown in the app and deducted from your earnings before payout.
• Host earnings become available after the booking ends. Hosts can withdraw available earnings to a verified UPI ID once they reach the minimum payout amount shown in the app, or set up automatic payouts.
• If we change our fees, the change applies only to bookings made after it takes effect. We will tell hosts in advance of any commission change.
• Prices are in Indian rupees. Paying for a booking outside ParkQ for a space found on ParkQ is not allowed.

Cancellations, no-shows & overstays

• Cancellations and refunds follow our Cancellation & Refund Policy and the terms shown on each booking.
• If a host cancels a confirmed booking, or the space is unavailable when you arrive, you get a full refund.
• If you do not arrive, the host can mark a no-show after the start time. A no-show is not refunded.
• If you stay past the end of your booking, overstay charges may apply after a short grace period. The grace period, rate and cap are shown on the booking. You agree to pay them.
• No-shows, late host cancellations and other breaches can lead to strikes on your account. Repeated strikes can lead to suspension.

Promotions & wallet credits

• Promo codes, first-booking offers and referral rewards are subject to the conditions shown with each offer, and we may change or end them.
• Wallet credits can only be used on ParkQ bookings. They have no cash value and cannot be transferred or withdrawn.
• We may cancel credits or rewards obtained through fraud, duplicate accounts or misuse.

Your content

You keep ownership of the photos, listings, reviews and messages you post. You give ParkQ a non-exclusive, royalty-free licence to host, display and use that content to run and promote the Service. You must have the right to post it, and it must be accurate and lawful.

Reviews must reflect a genuine experience. We do not edit reviews to change their meaning, but we may remove reviews that break these Terms or our Community Guidelines.

Acceptable use

You must not post, share or do anything on ParkQ that:

• Belongs to someone else and you have no right to use.
• Is obscene, pornographic, invasive of another person's privacy, harassing, hateful, or encourages money laundering or gambling.
• Is harmful to children.
• Infringes a patent, trademark, copyright or other proprietary right.
• Deceives or misleads about where it came from, or knowingly shares false or misleading information.
• Impersonates another person.
• Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order.
• Contains viruses or other code designed to interfere with any computer system.
• Breaks any law in force.

You also must not:

• List a space you do not have the right to rent, or post fake or duplicate listings.
• Harass, threaten or harm other users, or misuse their personal details.
• Scrape the Service, interfere with its security, or create multiple accounts to abuse offers or avoid a suspension.

Zero tolerance for objectionable content

ParkQ has zero tolerance for objectionable content and abusive users. You must not post listings, photos, reviews, messages or names that are offensive, hateful, sexual, threatening, harassing, misleading or illegal, or use ParkQ to abuse anyone.

You can report any listing, review or user in the app, and block any user. Blocking stops contact and hides that person's listings and reviews from you. We review reports within 24 hours, remove content that breaks these rules, and suspend or ban the users responsible.

Suspension & termination

We may suspend or close an account, remove content, or hold payouts under investigation if you break these Terms, the law or our Community Guidelines, or if needed for safety or fraud prevention. Where reasonable, we will tell you why and give you a chance to respond.

You can delete your account at any time in the app under Settings. Bookings and payouts that are already in progress are settled under these Terms.

Disclaimers & liability

We work to keep the Service available and accurate, but it is provided "as is" and "as available". We do not guarantee that a space will meet your needs beyond its listing, or that the Service will be uninterrupted.

To the maximum extent permitted by law, ParkQ is not liable for:

• Theft of, or damage to, a vehicle or its contents, or injury, at a listed space, which is a matter between the parker and the host.
• The acts or omissions of hosts, parkers or other third parties.
• Indirect, incidental, special or consequential loss, or loss of profit.
• Events outside our reasonable control.

Our total liability for any claim relating to a booking is limited to the amount paid to ParkQ for that booking. Nothing in these Terms limits liability that cannot be limited under Indian law, or your rights under the Consumer Protection Act, 2019.

Indemnity

You agree to compensate ParkQ for losses and reasonable costs arising from your breach of these Terms, your misuse of the Service, or, for hosts, any claim that you did not have the right to rent out your space.

Governing law & disputes

These Terms are governed by the laws of India. Please raise any complaint first with our Grievance Officer (see Grievance Redressal) so we can try to fix it.

If a dispute is not resolved within 30 days, it will be settled by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by mutual agreement (or, failing agreement, as provided in that Act). The seat and venue of arbitration is Hyderabad, Telangana, and the language is English. Subject to this, the courts at Hyderabad, Telangana have exclusive jurisdiction.

This section does not stop you from approaching a consumer commission or other forum available to you under the Consumer Protection Act, 2019.

General

• Changes: we may update these Terms. We will update the date at the top of this page and tell you in the app before significant changes take effect. Continuing to use the Service after that means you accept the updated Terms.
• Annual notice: we will remind you at least once a year that breaking these Terms can lead to suspension or termination of your account.
• Severability: if any part of these Terms is found unenforceable, the rest still applies.
• Assignment: you may not transfer your account or these Terms. We may transfer them to a successor business.
